1. Acceptance of Terms

By accessing and using the website of Desert Air Solutions LLC ("Company," "we," "us," or "our") or by engaging our HVAC services, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services. These terms apply to all visitors, users, and customers of Desert Air Solutions LLC.

Desert Air Solutions LLC is a licensed HVAC contractor located at 4416 Rhineland Dr, Fort Irwin, CA 92310, serving the High Desert region of California including Fort Irwin, Barstow, Victorville, Apple Valley, Hesperia, Adelanto, and surrounding San Bernardino County communities.

2. Website Usage

You may use our website for lawful purposes only. You agree not to use our website in any way that violates applicable federal, state, or local laws or regulations. You agree not to transmit any material that is defamatory, offensive, or otherwise objectionable. We reserve the right to terminate your access to our website at any time without notice for conduct that we believe violates these Terms and Conditions.

3. Quotes and Estimates

All quotes and estimates provided by Desert Air Solutions LLC are valid for 30 days from the date of issuance unless otherwise stated. Estimates are based on information provided at the time of assessment and may be subject to change if additional issues are discovered during service. We provide transparent, flat-rate pricing for standard services. For complex installations or repairs, a detailed written estimate will be provided before work begins.

Online estimates and calculator results are for informational purposes only and do not constitute a binding quote. A licensed technician must perform an on-site assessment to provide an accurate, binding estimate.

4. Scheduling Policies

Service appointments are scheduled based on technician availability. We make every effort to accommodate your preferred appointment time. Same-day service is available for emergency situations and is subject to technician availability. We will contact you to confirm your appointment within 2 hours of your service request during business hours.

If you need to reschedule or cancel an appointment, please notify us at least 24 hours in advance. Cancellations made less than 24 hours before a scheduled appointment may be subject to a cancellation fee. Emergency service calls are available 24/7 and may be subject to after-hours service rates.

5. Payments

Payment is due upon completion of service unless other arrangements have been made in advance. We accept cash, check, and all major credit cards. For larger installations, a deposit may be required to secure materials and scheduling. Financing options are available through our approved financing partners, subject to credit approval.

Invoices not paid within 30 days of the service date may be subject to a late payment fee of 1.5% per month on the outstanding balance. Desert Air Solutions LLC reserves the right to pursue collection of unpaid balances through all available legal means.

6. Service Agreements

Our Comfort Care Membership program is governed by a separate service agreement. Membership benefits, pricing, and terms are outlined in the membership agreement provided at the time of enrollment. Membership fees are billed monthly or annually as selected and are non-refundable except as provided in our Refund Policy.

7. Warranties

Desert Air Solutions LLC warrants all labor and workmanship for a period of 90 days from the date of service. Equipment and parts are covered by the manufacturer's warranty, which varies by product. We will assist you in processing manufacturer warranty claims at no additional charge.

Warranties are void if the HVAC system has been modified, improperly maintained, or damaged by misuse, neglect, accidents, or unauthorized repairs. Warranty claims must be submitted within the warranty period and are subject to inspection by our technicians.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Desert Air Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with our services or these Terms and Conditions.

Our total liability to you for any claims arising from our services shall not exceed the amount you paid for the specific service giving rise to the claim. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

9. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Desert Air Solutions LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our express written permission.

10. User Responsibilities

You are responsible for ensuring that our technicians have safe and unobstructed access to your HVAC equipment. You agree to provide accurate information about your property and HVAC system when requesting service. You are responsible for maintaining your HVAC system in accordance with manufacturer recommendations and our service recommendations.

11. Prohibited Activities

You agree not to engage in any of the following activities:

• Using our website for any unlawful purpose
• Attempting to gain unauthorized access to our systems
• Transmitting viruses or other malicious code
• Collecting or harvesting personal information from our website
• Using our services to harm, threaten, or harass others
• Misrepresenting your identity or affiliation

12. Cancellation Policies

Service appointments may be cancelled without charge if notice is provided at least 24 hours before the scheduled appointment time. Cancellations with less than 24 hours notice may incur a cancellation fee of up to $75. Emergency service calls that are cancelled after a technician has been dispatched will be charged a trip fee.

Comfort Care Membership subscriptions may be cancelled at any time with 30 days written notice. Cancellations take effect at the end of the current billing period. No refunds are provided for partial membership periods.

13. Dispute Resolution

In the event of a dispute arising from our services or these Terms and Conditions, we encourage you to contact us first to attempt to resolve the matter informally. Most disputes can be resolved quickly through direct communication. If informal resolution is not possible, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings arising from these terms shall be brought in the courts of San Bernardino County, California.

15. Termination

We reserve the right to terminate or suspend your access to our services at any time, without notice, for conduct that we believe violates these Terms and Conditions or is harmful to other customers, us, third parties, or for any other reason at our sole discretion.
